Using BEAM Connect
As a condition of your use of BEAM (including beam.biz, beam.today, or beam.business domains and its related websites, services, applications and tools) you agree that you will not:
Violate any laws; Violate the Posting Rules;
Post any threatening, abusive, defamatory, obscene or indecent material;
Post or otherwise communicate any false or misleading material or message of any kind;
Infringe any third-party right;
Distribute spam, chain letters, or promote pyramid schemes;
Distribute viruses or any other technologies that may harm BEAM or the interests or property of BEAM users;
Impose or contribute to imposing an unreasonable load on our infrastructure or interfere with the proper working of BEAM;
Copy, modify, or distribute any other person's content without their consent;
Use any robot spider, scraper or other automated means to access BEAM and collect content for any purpose without our express written permission;
Harvest or otherwise collect information about others, including email addresses, without their consent;
Copy, modify or distribute rights or content from the BEAM site, services, applications or tools or BEAM's copyrights and trademarks;
Harvest or otherwise collect information about users, including email addresses, without their consent
Bypass measures used to prevent or restrict access to BEAM;
Sell any counterfeit items or otherwise infringe the copyright, trademark or other rights of third parties.
Sell or market any form of products/services related to pyramid schemes, multi-level plans, or financial/insurance-related products.
BEAM and the BEAM community work together to keep the BEAM websites, services, applications and tools working properly and the community safe. Please report problems, offensive content and policy breaches to us using the reporting system.
Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off BEAM if we think that they are creating problems, infringing the rights of third parties or acting inconsistently with the letter or spirit of our policies (including, without limitation, circumventing temporary or permanent suspensions or harassing the BEAM employees or other users). However, whether we decide to take any of these steps, remove hosted content or keep a user off BEAM or not, we do not have any obligation to monitor the information transmitted or stored on our sites, services, applications and tools and we do not accept any liability for unauthorized or unlawful content on BEAM or use of BEAM by users.
Subscription Service - Automatic Payments (For web)
If you choose a Subscription Service, you hereby grant BEAM permission to automatically charge the subscription fee to your chosen payment method at the beginning of each applicable payment period. Your access to the Subscription Services will not be established until BEAM has verified that the credit card or other payment information you provide BEAM for payment is accurate and that your payment method account is in good standing.
You further agree that BEAM may charge any other applicable fees for the BEAM Service, including any early termination fee, to your payment method.
You are required to keep your billing information current, complete and accurate (for example, if you move, be sure to update your billing address, if you get a new credit/debit card, make sure you update the card number and/or expiration date) and notify BEAM if your selected payment method is cancelled (e.g., for loss or theft).
BEAM reserves the right to suspend or terminate your access to any Subscription Service that is a part of the BEAM Service without notice upon rejection of any charges or if your payment method (or its agent or affiliate) seeks return of payments previously made to BEAM when BEAM believes you are liable for the charges.
Cancellation of Subscription Services
You may choose not to renew your Subscription Service at any time by cancelling the subscription/auto renewal payments on your PayPal account. Your cancellation is effective at the end of the current subscription term.
When you make a purchase on the BEAM Service, you have immediate access to and use of the BEAM Products and Services you have purchased. Accordingly, you lose your right to cancel once you have made your purchase and we do not offer any refunds or credits, including fees for Subscription Services.
Payment Method and Terms
We currently accept major credit cards, certain debit cards, PayPal, and/or such other payment methods we may make available to you from time-to-time through our website/mobile applications, as forms of payment. You are subject to all terms and conditions of the payment method you choose. By submitting an order through the BEAM Service, you authorize BEAM, or its designated payment processor, to charge the account you specify for the purchase amount. All payments are to be made in United States Dollars, except where other currencies are offered via the payment methods made available by BEAM.
PLEASE NOTE: If a purchase has been declined online due to issues with your payment method, please ensure all data is correct and resubmit. If the transaction is not accepted online, please contact us at firstname.lastname@example.org, beam.today, or beam.business domains.
BEAM may impose an additional transaction fee based on transactions associated with BEAM Service, including a transaction fee applied to purchases from third parties. Such transaction fee will be disclosed to you prior to your consummation of the relevant transaction.
With respect to BEAM Products and Services you purchase in connection with the BEAM Service, you acknowledge and agree that upon making such BEAM Products and Services available to you (or to their intended authorized recipients), BEAM will have fully satisfied its obligation to deliver or otherwise provide such products, services or digital content, regardless of any failure or inability to use such products, services or digital content.
Service Descriptions and Availability, Errors
BEAM and its suppliers and licensors continually upgrade and revise the BEAM Service to provide you with new BEAM Products and Services. BEAM may revise, discontinue or modify BEAM Products and Services at any time without prior notice to you, and BEAM Products and Services may become unavailable without notice. BEAM shall have no liability of any kind if an BEAM Service that has been ordered is unavailable. If necessary, BEAM reserves the right to cancel an order or substitute BEAM Product or Service of equal or greater value when a product, service or digital content is unavailable
We attempt to be as accurate as possible and eliminate errors on the BEAM Service; however we do not warrant that any BEAM Products and Services or description, photograph, pricing or other information of a product, service or digital content is accurate, complete, reliable, current, or error-free. In the event of an error, whether on the BEAM Service, in an order confirmation, in processing an order, delivering an BEAM Product or Service or otherwise, we reserve the right to correct such error and revise your order accordingly if necessary (including charging the correct price) or to cancel the order and refund any amount charged. In addition, we may, in lieu of a refund as provided in this paragraph, opt to provide you with a service credit, with a value equal to the amount charged to your payment method. BEAM reserves the right to determine and modify from time to time the exact nature of any such service credit, including conversion into one or more different types of BEAM Products and Services credits. Your sole remedy in the event of such error is to cancel your order and obtain a refund or credit as set forth above.
You are responsible for any applicable sales or use tax, duties, or other governmental taxes or fees payable in connection with your purchase. If you do not pay such sales or other tax or fee on a transaction, you will be responsible for such taxes or fees in the event that they are later determined to be payable on such sale, and BEAM reserves the right to collect such taxes or other fees from you at any time.
Some of BEAM's features may display your ad on other sites, services, applications and tools that are part of the global BEAM community in other countries. By using BEAM, you agree that your ads can be displayed on these other sites, services, applications and tools. The terms for our other sites, services, applications and tools are similar to these terms, but you may be subject to additional laws or other restrictions in the countries where your ad is posted. When you choose to post your ad on another site, service, application or tool, you may be responsible for ensuring that it does not violate such other site, service, application and tool policies. We may remove your ad if it is reported on any our sites, services, applications or tools, or if we believe it causes problems or violates any law or policy.
Fees and Services
Using BEAM is generally free, but we sometimes charge a fee for certain services. If the service you use incurs a fee, you'll be able to review and accept terms that will be clearly disclosed at the time you post your ad. Our fees are quoted in US Dollars, and we may change them from time to time. We'll notify you of changes to our fee policy by posting such changes on the BEAM website. We may choose to temporarily change our fees for promotional events or new services; these changes are effective when we announce the promotional event or new service.
If your ads went live with exposure on the BEAM sites, services, applications or tools, even for a limited time, and that they benefited from the service associated with the paid fee;
If your ads are placed in inappropriate categories;
If your ads are placed into "edit" mode and will go live to site once updated by you;
If you have removed your ads yourself;
If you post duplicate ads as defined in our rules regarding duplicate ads;
If we believe that your ads are in a significantly wrong category;

BEAM contains content from us, you, and other users. BEAM is protected by copyright laws and international treaties. Content displayed on or via BEAM is protected as a collective work and/or compilation, pursuant to copyrights laws and international conventions. You agree not to copy, distribute or modify content from BEAM without our express written consent. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in BEAM. Without limiting the foregoing, you agree not to reproduce, copy, sell, resell, or exploit for any purposes any aspect of BEAM (other than your own content). When you give us content, you grant us and represent that you have the right to grant us, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise any and all copyright, publicity, trademarks, design, database and intellectual property rights to that content, in any media whether now know or to be discovered in the future and on all other sites, services, applications and tools that are part of the global BEAM community, such as BEAM or our classifieds sites in other countries. In addition, you waive all moral rights you have in the content to the fullest extent permitted by law.
Do not post content that infringes the rights of third parties. This includes, but is not limited to, content that infringes on intellectual property rights such as copyright, design and trademark (e.g. offering counterfeit items for sale). A large number of products of all sorts are offered on BEAM by private individuals. Entitled parties, in particular owners of copyright, trademark rights or other rights can report any advertisement which may infringe on their rights, and submit a request for such advertisement to be removed. If a legal representative of the entitled party reports this to us in the correct manner, products infringing on the intellectual property rights will be removed by BEAM.
Reporting an infringement
In order to participate in the Notice of Infringement Programme, you only need to complete a Notice of Infringement Form and fax it to BEAM. You can use this form, complete with your signature, to report advertisements which may infringe on your property rights. The information requested in the Notice of Infringement Form is for the purpose of ensuring that the parties reporting these objects are either the entitled party or their officially authorized representative. This information must also enable BEAM to identify the advertisement to be removed. Once we have received your correctly completed Notice of Infringement Form, you can simply send later reports to BEAM via the e-mail address provided.
Note: This form can only be used by the lawful owners of the relevant intellectual property rights. The "Notice of Infringement" is intended to enable rights owners to ensure that products offered by BEAM users do not infringe their copyright, trademark rights or other intellectual property rights. Nothing in these terms shall limit our liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence or the negligence of our agents or employees. You agree not to hold us responsible for things other users post or do.
We do not review users' postings and are not involved in the actual transactions between users. As most of the content on BEAM comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what's offered.
In no event do we accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law.
You acknowledge that we cannot guarantee continuous, error-free or secure access to our services or that defects in the service will be corrected. While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the operation and availability of our sites, services, applications or tools.
Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of, or inability to use BEAM, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.
If you have a dispute with one or more BEAM users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.
Third party rights
A person who is not a party to this Agreement has no right to enforce any term of this User Agreement but this does not affect any right or remedy of a third party specified in this Agreement or which exists or is available apart from that Act.
Resolution of Disputes
If a dispute arises between you and BEAM, we strongly encourage you to first contact us directly to seek a resolution by going to the BEAM Help page. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
These terms and the other policies posted on BEAM constitute the entire agreement between BEAM and you, superseding any prior agreements. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
If we don't enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below.
We may update this agreement at any time, with updates taking effect when you next post or 30 days after we post the updated policy on the BEAM website, whichever is sooner. No other amendment to this agreement will be effective unless made in writing, signed by users and by us.
2. What personal information do we collect
You can visit our Website without registering for an account. When you decide to provide us with your personal information, you agree that such information is sent to and stored on our servers. We collect the following types of personal information:
Information we collect automatically: When you visit our Website, use our Services and or reply to ads or other content, we automatically collect the information sent to us by your computer, mobile device or other equipment that provides access. This information includes, but is not limited to:

An intellectual property owner if the owner of an intellectual property right or an intermediary in good faith believes that an advertisement violates the rights of the owner. Before personal information is provided, the IP owner will enter into an agreement that, inter alia, stipulates that information is only provided on the strict condition that it may only be used in the context of legal proceedings and/or obtaining legal advice and/or to answer questions from the relevant advertiser
Without limitation to the foregoing, we shall moreover - in our efforts to respect your privacy and to keep the website free of malicious persons or parties - not disclose your personal information to third parties without a court order or formal request from the government in accordance with applicable law, unless we believe in good faith that such disclosure (i) is necessary for the purpose of, or in connection with, any legal proceedings (including prospective legal proceedings), for the purpose of obtaining legal advice or is necessary for the purposes of establishing, exercising or defending legal rights, (ii) is necessary for the prevention or detection of crime, the capture or prosecution of offenders, or the assessment or collection of tax or duty, (iii) is requested by a body that performs public regulatory functions.

Since our Website also enables you to directly contact a buyer or seller, we recommend that you consider how you share your personal information with others. You are solely responsible for the personal information you share through our Website and therefore we cannot guarantee the privacy or security of the information shared by you with other users.

6. Accessing, Reviewing and Changing Your Personal Information
We cannot modify your personal information or account information. You can modify your own information by logging into your BEAM account. If you want to close your account (where applicable) with us, please send us a request here. We will process your request within a reasonable period of time and process your personal information in accordance with applicable law. Alternatively, you can also contact Customer Support at email@example.com, beam.today, or beam.business domains to access your personal information stored by us that is not directly accessible on BEAM. We may charge a fee to compensate costs; however the fee shall not exceed the amount permitted by law. If your information is factually incorrect or incomplete or irrelevant for the purposes for which we process your information, you can request us to modify or delete your information.
7. Protection and retention of your personal information
We protect your information by using technical and administrative security measures (such as firewalls, data encryption, and physical and administrative access controls to the data and servers) that limit the risk of loss, abuse, unauthorised access, disclosure, and alteration. Nevertheless, if you believe your account has been abused, please contact us through the Contact Form.
We retain personal information no longer than is legally permissible and delete personal information when it is no longer necessary for the purposes as described above.
8. Other information
Abuse and unsolicited commercial communications ("spam"): We do not tolerate abuse of our Website. You do not have permission to add other BEAM users to your mailing list (e-mail or postal) for commercial purposes, even if a user has purchased something from you, unless the user has given his explicit consent.
